TERMS & CONDITIONS

Electrical Allsorts (Electrical Allsorts [SA] Pty Ltd)
1. Invoices are due and payable on receipt (net 7 days) - no further accounts or statements will be issued. Any unpaid account will have interest accrued at 2% accumulative per month ongoing. Interest will apply to all outstanding monies after 30 days.
  • If a customer defaults on payment then the customer shall indemnify Electrical Allsorts (SA) Pty Ltd (further referred to as Electrical Allsorts) from and against all costs and disbursements incurred in pursuing the debt. These costs include but are not limited to collection agency costs, Form 1A, Form 3 and other legal costs.
2. Electrical Allsorts will charged a minimum 1 hour for all work undertaken after the first hour charges will be in 15 minutes increments.

3. Electrical Allsorts will charge a kilometre rate for all work undertaken outside of Murray Bridge.

4. Electrical Allsorts may charge emergency/priority fees for all work that is booked and undertaken on the same day.

5. Electrical Allsorts may charge time and half or double time for work that is outside the normal working hours of 8am -4pm Monday - Friday (not including public holidays).

6. Electrical Allsorts retains title to all goods and material supplied until payment has been made in full.

7. At its sole discretion, Electrical Allsorts will either replace or remedy defects in workmanship which have become apparent and reported to Electrical Allsorts within 12 months of the work being done. Goods and materials shall have the benefit of the manufacturer's warranty.

8. Where the customer has left any item with Electrical Allsorts for repair and Electrical Allsorts has not received payment for such repair after 120 days then Electrical Allsorts shall have the right to retain and sell the item to recover outstanding costs.

9. Electrical Allsorts shall assign the benefit to the buyer (recipient) of warranties or guarantees in relation to the goods which the company receives from its own supplier(s). Electrical Allsorts shall not be held liable for either or consequential loss or damage as a result of materials or products installed.
The warranty shall not cover any defect or damage which may be caused by or arise through failure by the customer to properly maintain goods or follow any instruction or guidelines provided by Electrical Allsorts.

10. Even when Electrical Allsorts retains ownership of the goods, all risk for those goods passes to the customer on delivery.

11. Nothing in this agreement is intended to have the effect of overriding any applicable provisions of The Commonwealth Trade Practices Act 1974 and Fair Trading Acts in each of the States and Territories of Australia expect to the extent permitted by those Acts where applicable.

12. Electrical Allsorts may supply goods and services by separate installments. Each separate installment shall be invoiced and paid in accordance with the provisions in these Terms and Conditions. Electrical Allsorts has the right to subcontract work out of third parties.

13. Electrical Allsorts has the right to have the customer listed as a defaulter with any or all debt collection agencies should the customer fail to settle the account as per these Terms and Conditions. The customer consents to Electrical Allsorts being given a consumer credit report in its endeavour to collect any overdue payments on commercial credit. Section 18K(1)(h) of the privacy act 1998 applies. Electrical Allsorts may give information about the customer to a credit reporting agency to obtain a consumer credit report. Electrical Allsorts may allow the credit reporting agency to create or maintain a credit information file about the customer.

14. Opinion, advice or information given by employees of Electrical Allsorts or agents for Electrical Allsorts in relation to the use of goods or materials is given in good faith and without legal responsibility. It is for the buyer (recipient) to be satisfied as the suitability of the goods supplied for their particular purpose.

15. Upon signing this document, the customer agrees to be bound by terms and conditions expressly detailed herewith.
